Obtaining and Defending Against Injunctions in Trademark Cases (Live)

This webinar will begin with a brief explaination of the bases for granting injunctive relief, including the Lanham Act and the common law. Ketan and Greg will discuss what showing a trademark owner is required to make in order to obtain injunctive relief—specifically discussing the factors a court considers when determining likelihood of success on the merits. Additionally, the following various factors a court considers when determining the proper scope of an injunction will be presented, including: (1) the intent of the defendant; (2) the strength of the mark being infringed; (3) whether the value of the mark is being diluted; (4) territorial issues relating to the injunction; and (5) laches.
